Since the practice of some distributors to refuse at the outset of negotiations the price increases requested by suppliers and their general terms of sale is terminated, the annual agreement must indicate the price list previously communicated by the supplier or, at the very least, indicate how to access the price list in the version that served as the basis for the negotiations. Finally, OQALI intervenes in the debate on extending its methodology for monitoring the nutritional quality of food supply to restaurants and food products and overseas territories. On January 29, 2014, the Senate passed at second reading the text of the future Hamon Act (Hamon Act), which is now being considered by a joint committee of both chambers. An initial assessment of the changes made by the future law to the rules applicable to trade relations in order to continue to combat late payments and strengthen the negotiating framework for business can be considered in the first instance. On Wednesday 11 December, ANSES, INRA and the ministries of health, consumers and agri-food signed a new framework agreement for the French Food Observatory (OQALI) for the period 2020-2023. This will enable the Observatory to continue and strengthen its missions to monitor the nutritional quality of the supply of processed products in order to support public food policies. Each year, it publishes reports on changes in the nutritional quality of food supply by sector, as well as specific studies on these changes, on ingredients and on the link between nutritional quality and economic data on products. The last report, published in November 2019, focused on the use of additives in processed products. The provisions of Article L. 441-7 2, relating to commercial cooperation services, i.e.

the services provided by the distributor in connection with the sale of the products (advertising, posting reports, cataloguing, etc.), remain unchanged and still need to be defined in the annual agreement by specifying their purpose, date and conditions of implementation, as well as the corresponding fees charged by the distributor to the supplier. The upcoming law will create a legal framework for the advertising benefits granted by the supplier to end customers (three-for-two virtual package offers, the second half-price item, loyalty cards, discount coupons, etc.). The amount and nature of these promotional benefits, as well as the period during which benefits are granted, and their terms of execution, must be determined by specific agreements with the distributor. The role of OQALI is to monitor the supply of processed foods on the French market by measuring changes in nutritional quality, including nutritional composition and available information on labelling. Created by the Law of 27 July 2010 on the modernization of agriculture and fisheries, OQALI was confirmed by the law of 30 October 2018 on the trade balance in the agri-food sector and healthy, sustainable and accessible foods, known as “EGAlim”, and is operated by INRA and ANSES.
